In recent years, Chinese companies have frequently encountered US “337 investigations†on intellectual property infringement, which only reached 19 cases last year.
Shen Changyu pointed out in this regard that with the increasing trade between China and the United States, disputes over intellectual property rights between China and the United States have also increased. China has become the main target country and the largest victim country of the United States' "337 investigation."
“Section 337 investigation†refers to the US International Trade Commission’s investigation of unfair trade practices infringing on registered intellectual property rights in the United States under section 337 of the Tariff Act of 1930. The low threshold for the investigation and severe sanctions, the short time for responding and the high litigation costs have become major obstacles to the Chinese enterprises’ export to the United States.
According to Shen Changyu, Chinese companies are actively responding to the increasing number of "337 investigations." For example, ZTE Corporation has suffered six US “337 investigations†in recent years, but through active response, from last December to March this year, it won three final awards in succession.
Shen Changyu pointed out that when Chinese companies go to the international market, they must first do a good job of intellectual property rights, actively apply for patents overseas, and strengthen their protection of intellectual property rights; secondly, they should be good at and dare to use intellectual property rules to safeguard their own legitimate rights and interests, To deal with various intellectual property disputes.
New Trademark Law will make trademark registration more convenient
The newly revised trademark law will be implemented on May 1 this year. Liu Junchen pointed out that this amendment has facilitated the registration of trademarks and increased the protection of intellectual property, mainly in the following three aspects:
First, trademark registration will be more convenient. It takes about 30 months to register a trademark five years ago and it has been compressed to less than 10 months last year. The new trademark law provides that the statutory time limit for the examination of a trademark is 9 months.
The second is more effective regulation of trademark registration, use, and agency. Such as: clarify the well-known trademark protection system and guide the return of well-known trademarks. Another example: the supervision of trademark agencies has been further strengthened, and serious business violations may be suspended by law.
The third is more effective protection of trademark exclusive rights. The new trademark law further intensified the crackdown on various trademark infringements and increased punitive compensation provisions. According to this law, the State Administration for Industry and Commerce will further intensify investigation and infringement of various trademark infringements.
